Justice Stephen J. Field was the champion of a form of liberalism often said to be especially friendly to capitalism, the approach to the Constitution traditionally identified with “Lochnerism,” i.e., a laissez-faire oriented judicial activism. More recently a form of judicial revisionism has arisen, challenging the accepted descriptions of “Lochnerism” and of Field's jurisprudence. This article is an attempt to extend the revisionist approach by arriving at a more satisfactory understanding of the grounding of Field's jurisprudence in the natural rights (...) philosophy. Field, it turns out, orienting around natural rights, was not so unambiguously friendly to capitalism as previous generations of scholars maintained, but his approach is surely friendlier than the constitutional theories that have replaced natural rights since Field's day. William James once said that truth is “the good in the way of belief.” This has the ring of, well, truth. While it may appear as if James’ claim is straightforwardly true, I think that there are at least three different dimensions along which truth can be normatively related to belief. In this paper, I explore these different dimensions of truth’s value, considering both how they differ and how they relate. As we will see, our understanding of these different dimensions (...) of truth’s value can impact our understanding of its nature. I argue that a fuller understanding of the connections between truth’s normative dimensions pushes us in a decidedly pragmatist and pluralist direction—something of which I believe James would approve. Are most people sincere when they share misinformation and conspiracies online? This question, while natural and important, is difficult to answer for obvious reasons. But it also applies poorly to one of the main vehicles for misinformation—memes. And it can be ambiguous; as a result, we should be mindful of two distinctions. First, a distinction between belief and a related propositional attitude, commitment. And second, the distinction between the propositional content of an attitude and what I will call its political (...) meaning. I will suggest that these distinctions not only can help us understand how we communicate online, but they also suggest a lesson about what we should be focusing on when fighting misinformation. Minimalists generally see themselves as engaged in a descriptive project. They maintain that they can explain everything we want to say about truth without appealing to anything other than the T-schema, i.e., the idea that the proposition that p is true iff p. I argue that despite recent claims to the contrary, minimalists cannot explain one important belief many people have about truth, namely, that truth is good. After briefly presenting the views main principles and motivations, I defend alethic functionalism from recent criticisms raised against it by Cory Wright. Wright argues that alethic functionalism will collapse either into deflationism or into a view that takes true as simply ambiguous. I reject both claims.

The practice of recontact in genomic medicine has the power to help rectify long‐standing inequities in genetic testing. However, if not delivered systematically, recontacting practices also have the potential to reinforce these same inequities. Recontact, which occurs when contact between a clinician and patient is reinitiated after a relationship has ended, is often in search of or in response to updated interpretation or results. Currently, recontact is happening in a patient‐driven and ad hoc manner, undermining its potential to benefit all (...) patients. In this paper, the authors position justice as an additional argument in favor of systematic recontact and an argument against the predominantly patient‐initiated model. They argue that patients from equity‐deserving groups should be early beneficiaries of an emerging responsibility to recontact patients. The authors share illustrative clinical vignettes and propose role‐specific and systems‐level solutions to rightfully position recontact as a tool to promote a more equitable clinical genomics future. The compatibility, or lack thereof, between Catholicism and American citizenship is continually raised by Catholic political theorists. With each new political crisis we face as a nation, proponents and opponents trot out their arguments in an attempt to prove that Americanism continues to nourish, or poison, the Body of Christ. This argument has been raging for nearly 200 years, and today an important contributor to this conversation is often overlooked: Orestes Brownson. While in his magnum opus, The American Republic, he (...) spoke eloquently of America’s providential and Catholic mission, in 1870 he confided in Isaac Hecker that he had lost all hope for America and saw her as a corrupting influence on the Church in America. In this essay I explore Brownson as for and against America, showing how his later book, Conversations: Liberalism and the Church, reveals a consistency between his apparently contradictory stances. The DRM paradigm produces robust false memories of non-presented critical words. After studying a thematic word list participants falsely remember the critical item “sleep.” We report two false memory experiments. Study One introduces a novel use of the lexical decision task to prime critical words. Participants see two letter-strings and make timed responses indicating whether they are both words. The word pairs Night-Bed and Dream-Thweeb both prime “sleep” but only one pair contains two words. Our primary purpose is to introduce (...) this new methodology via two pilot experiments. The results, considered preliminary, are promising as they indicate that participants were as likely to recognize critical words and presented words just as when studying thematic lists. Study Two actually employs the standard DRM lists so that semantic priming is in play there as well. The second study, however, uses functional near-infrared spectroscopy to measure activity in the prefrontal cortex during a DRM task which includes a deception phase where participants intentionally lie about critical lures. False and true memories occurred at high levels and activated many of the same brain regions but, compared to true memories, cortical activity was higher for false memories and lies. Accuracy findings are accompanied by confidence and reaction time results. Both investigations suggest that it is difficult to distinguish accurate from inaccurate memories. We explain results in terms of activation-monitoring theory and Fuzzy Trace Theory. We provide real world implications and suggest extending the present research to varying age groups and special populations. A nagging question has not been satisfactorily answered: Could neural pathways exist that signal the presence of false memories and lies? Answering this question will require imaging experiments that focus on regions of distinction such as the anterior prefrontal cortex. (shrink)

The Western world is currently gripped by an obsessive concern for the rights of animals - their uses and abuses. In this book, Leahy argues that this is a movement based upon a series of fundamental misconceptions about the basic nature of animals. This is a radical philosophical questioning of prevailing views on animal rights, which credit animals with a self-consciousness like ours. Leahy's conclusions have implications for issues such as bloodsports, meat eating and fur trading.

Scholars have assumed that trust is fragile: difficult to build and easily broken. We demonstrate, however, that in some cases trust is surprisingly robust—even when harmful deception is revealed, some individuals maintain high levels of trust in the deceiver. In this paper, we describe how implicit theories moderate the harmful effects of revealed deception on a key component of trust: perceptions of integrity. In a negotiation context, we show that people who hold incremental theories reduce perceptions of their counterpart’s integrity (...) after they learn that they were deceived, whereas people who hold entity theories maintain their first impressions after learning that they were deceived. Implicit theories influenced how targets interpreted evidence of deception. Individuals with incremental theories encoded revealed deception as an ethical violation; individuals with entity theories did not. These findings highlight the importance of implicit beliefs in understanding how trust changes over time. (shrink)

While some may argue that universities are in a state of crisis, others claim that we are living in a post-university era; a time after universities. If there was a battle for the survival of the institution, it is over and done with. The buildings still stand. Students enrol and may attend lectures, though let’s be clear—most do not. But virtually nothing real remains. What some mistakenly take to be a university is, in actuality, an ‘uncanny’ spectral presence; ‘the nagging (...) presence of an absence … a “spectralized amnesiac modernity with its delusional totalizing systems”’. It is the remains and remnants of the university.[1]Overstatement? Perhaps. We think many if not most administrators, at all levels, will likely dissent. So too will many if not most teachers and students. Trying to determine whether this is correct, or to what extent, by consulting polls and reading opinion pieces in various education journals and professional papers is likely to be of little help. In any case, it is the hypothesis, along with closely related ones, and concerns about what can be done in the circumstances, that have generated this special issue.This special issue highlights and illustrates that most of the contested issues regarding educational theory and practice central to how universities and schools should be, and how they should be run, are first and foremost questions of value rather than fact. The status of learning styles theory in educational studies is uncertain as we inhabit the liminal phase between the theory’s death as proclaimed by educational psychologists who avow to have disproven it and whatever afterlife will follow. At this moment, with both past and future in view, that we have an opportunity to reflect on the foundational assumptions of the theory. Engaging in the growing community of Agambenian philosophy of education and the ongoing dialogue around educational potentiality, this article approaches (...) learning styles theory as a paradigm of educational Megarianism. In this frame, the error of the learning styles theorists was not in the construction of a particular typology, but in the metaphysical approach to pedagogy. The reflection upon learning styles as paradigm also contributes a paradigmatic case of educational Megarianism to the discussion of potentiality in Agambenian philosophy of education. (shrink)
